Judge Rules Boshears Can Have a Second Trial

In Will County Court Tuesday, Judge David Carlson ruled that prosecutors can charge Jeremy Boshears in a second trial for the 2017 death of 24 year old Katie Kearns of New Lenox.  In his first trial, Boshears was convicted of killing Kearns at the Joliet Outlaws Club then putting her body in her SUV and stashing the vehicle in a Kankakee County barn.  In January, Carlson ruled Boshears does deserve a new trial.  Yesterday’s hearing was to hear a request from the defense to bar the prosecution from charging Boshears again, saying the case should be dismissed on grounds of double jeopardy.  The judge did not agree.  During the first trial the defense argued that Kearns had killed herself.
